Current Status and Recommendations for Government Regulatory Impact Analysis

    Korea government has adopted Regulatory Impact Analysis (hereafter referred to as RIA) since 1998, so as to prevent low quality regulation from being unexpectedly and excessively enacted. RIA is a kind of a decision-making tool which analyzes impacts or effects of the newly introduced regulation. RIA is regarded as an outpost and essential tool for regulatory reform in terms of providing primary motive to strengthen national competitiveness, to maximize private autonomy as well as cre-ativeness; accordingly, RIA ultimately enhance the quality of citizens’ life.

    The success of RIA program was fully dependent upon writing high quality-based RIA. However, according to the evaluation on RIAs conducted by NABO for the last three years, the quality of RIAs of Korea government still remains at low level.

    The present paper is written with the aim of identifying the actual conditions and problems of government RIAs, and then suggested some alternatives for im-provement.

    Firstly, when it comes to writing RIA, it is necessary to supplement to RIA guideline for summary of RIA and expected compliance rate of regulatory.

    Secondly, for implementing RIA system, it is required to amend relevant provi-sions of Administrative Regulation Basic Law, so that all the regulatory bills should be thoroughly reviewed by the regulatory reform committee in order to keep min-istries from judging whether bills contain regulatory provisions or not. In addition, regulatory sunset law should have substantial and direct effects on implementation. Moreover, it is recommended to revise related law to carry out RIA program in case of legislation proposed by members of the National Assembly.

    Thirdly, regarding review and evaluation on RIAs, it is necessary to introduce RIAs preview system by which major regulatory could be reviewed carefully from when drafting a regulatory law. Also, it is recommended that government should adopt outsourcing evaluation system to enhance the quality of RIAs.
